This website is owned and operated by Gazelle Travel Ltd of Gazelle House, 15 North Parade, Bradford, BD1 3JL trading as Faremine (“Faremine”, “we”, “us” and “our”). We are a limited company, registered in England, with registered company number 01526617.  References to “Website” in these Terms of Use means www.faremine.com.

In these Terms, “you” and “your” means any and all persons accessing and using this Website. This Website is for use by Faremine’s trade agents only. You must be an approved Faremine agent with a signed commercial agency agreement with Faremine (“Agency Agreement”) to use this Website.

  1. Your use of the website

Your use of the Website is subject to these Terms of Use (“Terms”) and the commercial agency agreement you have with Faremine (“Agency Agreement”), both of which apply to all transactions and bookings you make on this Website. By using this Website, you accept and agree to comply with these Terms. Failure to comply with any part of these Terms and/or your Agency Agreement may result in your access and permission to use this Website being revoked (in addition to any other rights we may have).

By using this Website, you warrant to us that:

  1. You will not use this Website or any material or information on it for any purpose that is unlawful or prohibited by these Terms or the Agency Agreement;
  2. You are at least 18 years old and have the legal authority to use this Website in accordance with these Terms and the Agency Agreement;
  3. You agree to be financially responsible for all charges, fees and other sums of whatever nature which arise out of your use of this Website;
  4. All information that you provide about you, customers and anyone else, will be true and accurate

You must not link (including deep linking) to our Website or access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our prior written agreement.

You will be able to access all relevant information or by logging onto the Website using the log-in details provided to you by Faremine. Faremine will provide you with a unique log-in and password (“Log-in Details”) to access the Website. You accept that you are responsible for keeping the Log-in Details strictly confidential and ensuring it is not disclosed to any third party. In the event you believe the confidentiality of the Log-in Details has been compromised for any reason whatsoever (including where a staff member with access to the Log-in Details has left), you must request new Log-in Details from Faremine without delay.

If misuse of the Log-in Details is suspected or proven, Faremine has the absolute right to deny any further access to the Website and to cancel any outstanding reservations made by the user of these Log-in Details. Any cancellation costs will be invoiced to you. You shall remain liable for all bookings made using your Log-in details, including where misuse is suspected or proven.

We may monitor look-to-book ratios where we suspect that a large number of searches are being undertaken that are not resulting in confirmed bookings. We will consider a ratio of 100:1 as a maximum threshold and where this is exceeded, we will consider this as misuse of our Website and may limit your access to the Website as a result.

We may alter these Terms at any time.  If we do so, all subsequent use of the Website will be governed by the newer version. You must check these Terms regularly.

  1. Our Service

Faremine is an IATA accredited airline ticket agent. Faremine also holds an ATOL with the Civil Aviation Authority under number 4067. Faremine acts as a distribution and ticketing agent on behalf of the airline at all times whether the sale comes under IATA or ATOL.

All information on the Website is provided by the airlines and not by Faremine. Therefore, we are not responsible for the accuracy of any information on the Website. We will, however, where possible, use reasonable endeavours to update or correct any inaccuracies on the Website which are brought to our attention.

As agent, we accept no responsibility for the actual provision of the flight arrangements. We accept no responsibility for any information about the flight arrangements that we pass on to you in good faith. Furthermore, please note that airlines reserve the right to amend (including shortening) the deadline for ticketing and we accept no responsibility for any further charges incurred due to increased fares or other costs.

Faremine does not hold ‘live’ inventory within the airline reservation system until such time as the ‘Book’ functionality is activated and a PNR reference is generated.

You may only use the Website to make legitimate and genuine reservations and transactions and you must not use the Website to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand.

Faremine reserves the right at any time and at its sole discretion to change, delete or move any of the material on the Website and to suspend or terminate your use, or deny you access to the Website.

  1. Website Content

We are an English registered company and our business and services we offer via this Website are governed by the applicable laws of England and Wales except where otherwise stated. No warranties, promises and/or representations of any kind, express or implied, are given as to the accuracy or completeness of any of the material or information contained on this Website (in accordance with English law or with any laws of any other country) or as to the nature, standard, suitability or otherwise of any services offered by us or on our behalf.

We shall not be liable for any loss or damage or other sum or claim of any nature whatsoever (direct, indirect, consequential or other) which arises, directly or indirectly, in connection with this Website.

The information contained on this Website may contain technical inaccuracies and typographical and other errors. The information on these pages may be updated from time to time and may at times be out of date. If any price or other information is obviously incorrect, we will not be bound by it. You must ensure you check all details of the chosen arrangements (including the price) with us at the time of booking.

This Website may contain links to other websites. Except where they belong to us, such other websites are not under our control or maintained by us. We are not responsible for the content of such websites. We provide these links for your convenience only but do not monitor or endorse the material on them. We cannot accept any liability in relation to any such other websites or in relation to any material or information appearing on them or which you may otherwise come across after leaving our site by way of a hypertext link or any other means.

 

This Website or any part of it (or any websites that are linked to this website) may not be compatible with your browser or computer configuration and we make no warranty that it is. We make no warranty that your access to our Website will be uninterrupted, timely or error free. It is your responsibility to ensure you carry out sufficient checks (including virus checks) to satisfy your particular requirements.

 

  1. Making a Booking

You are entitled to use the Website to reserve flights on behalf of customers on all fare types and classes available on the Website subject to the relevant fare class rules.

In making a booking, you agree that the information you have provided is accurate at the time you provided it. You must ensure that all details are correct at the time of booking (i.e. full name(s) of travellers as shown on their passports, correct email address, telephone numbers, postal address, etc.). We reserve the right to charge an administration fee in the event we have to correct errors after a booking has been made.

In using this Website to make a booking, you agree that you will comply and ensure that the customer also complies, with all applicable airlines rules and rates and you must pass these on to the customer.

In order to make a booking on the Website, you must select the chosen flight arrangements and make full payment at the time of booking (or where you have a credit account with Faremine, in accordance with the terms of your credit arrangement). You must also pay all applicable insurance premiums and booking fees. Upon clicking the ‘Book’ button on the Website, Faremine will check the availability and price of the chosen flight. We will send you an email acknowledging your booking. The booking acknowledgement is not confirmation of the booking. The booking is confirmed and a contract between the customer and airline will exist when we send you a booking confirmation and e-ticket on the airline’s behalf. Please note that a booking is only confirmed when we issue a booking ticket and/or e-ticket, bookings held on option are subject to price fluctuations until they have been ticketed and confirmed.

The booking details are those set out in our email to you which you must forward to the customer. Please check the confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport.

  1. Website accuracy

Whilst we have taken every due care and diligence with the production of our Website and price list, there may however be occasions beyond our control where certain fares are withdrawn by the airline and/or where ticketing deadlines are shortened. We will not be held responsible if for any reason these fares are withdrawn or ticketing deadlines are amended. No compensation is payable in the event of withdrawal of any fares. Air fares are not guaranteed until tickets are confirmed and purchased. All fares are subject to confirmation and change prior to ticket issue. The information contained on this Website may contain technical inaccuracies and typographical and other errors. The information on the Website may be updated from time to time and may at times be out of date. We have the right to change the details of the arrangements featured or mentioned on the Website at any time without prior notice. If any detail is obviously incorrect, we will not be bound by it.

All content on this Website (such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software) is our exclusive property or that of our content suppliers and advertisers, and is, unless specifically stated otherwise, protected by copyright or similar ownership rights.   1. Limitation of liability

Faremine acts as a booking agent in the promotion and sale of flights on the Website.

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our Website; or
  • use of or reliance on any content displayed on our Website.

 

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or

These Terms are governed by the laws of England and Wales. We both agree to submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or matter arising from the Terms.

If any exclusion(s) or limitation(s) contained in these Terms is found, in whole or part, to be unlawful, void or for any other reason unenforceable for any purpose(s), that exclusion(s) or limitation(s) or the part(s) in question shall be deemed severable and omitted from these Terms for that purpose / those purposes. Such omission shall not affect the validity, effectiveness or enforceability of the other provisions of these Terms.
